マッカーサー・ノート （マッカーサー三原則） 昭和21年2月3日 I The Emperor is at the head of the State. 天皇は国家元首の地位にある。 His succession is dynastic. 皇位は世襲される。 His duties and powers will be exercised in accordance with the Constitution and responsible to the basic will of the people as provided therein. 天皇の職務と権限は、憲法に基づいて行使され、憲法の定めるところにより、国民の基本的意思に対して責任を負う。 II War as a sovereign right of the nation is abolished. 国家の主権としての戦争は廃止される。 Japan renounces it as an instrumentality for settling its disputes and even for preserving its own security. 日本は、紛争解決の手段としての戦争のみならず、自国の安全を維持する手段としての戦争も放棄する。 It relies upon the higher ideals which are now stirring the world for its defense and its protection. 日本は、その防衛と保護を、今や世界を動かしつつある崇高な理想に信頼する。 No Japanese army, navy, or air force will ever be authorized and no rights of belligerency will ever be conferred upon any Japanese force. 日本が陸海空軍を保有することは、将来ともに許可されることがなく、日本軍に交戦権が与えられることもない。 III The feudal system of Japan will cease. 日本の封建制度は廃止される。 No rights of peerage except those of the Imperial Family will extend beyond the limits of those now existent. 華族の権利は、皇族を除き、現在生存する一代以上に及ばない。 No patent of nobility will from this time forth embody within itself any national or civic power of government. 華族の特権は、今後、国または地方のいかなる政治的権力も包含するものではない。 Pattern budget after British system. 予算は英国の制度を手本とする。 昭和21年2月3日、占領下日本における最高権力者であったマッカーサーは、日本の新憲法を作成せよと、その要点を三原則の形にして、ホイットニー民政局長に指示しました。被占領国の憲法に介入するなど、もちろん国際法違反です。 ですから、形の上では日本の国会が審議して、あくまでも自主的に憲法を改正したように見せかけることになります。 注目すべきは、自衛のための戦争も明確に否定している点です。「世界を動かしつつある崇高な理想」が具体的に何を指しているのかは、よくわかりません。実際には、占領軍しかいないはずです。 この時点でのマッカーサーは、ポツダム宣言と同じく、日本軍さえいなければ東アジアは平和になると空想していたようです。 参考文献 『國破れてマッカーサー』、西 鋭夫、中央公論新社 上記の本にマッカーサー・ノートの英文が収録されています。 『憲法はかくして作られた』、日本政策研究センター 和文は上記の本を参考にして翻訳しました。 |
